Michael A. Falcone

Michael A Falcone

In May 2025, Michael A. Falcone was named Acting Chief Counsel for the Transportation Security Administration (TSA). Falcone is part of TSA’s senior management team and is responsible for advising TSA and the U.S. Department of Homeland Security (DHS) senior leaders on all legal matters pertaining to TSA’s transportation security mission. Falcone’s permanent position is the Deputy Principal Legal Advisor for Field Legal Operations, Office of the Principal Legal Advisor (OPLA), U.S. Immigration and Customs Enforcement (ICE). In this role, Michael is responsible for overseeing more than 1,700 employees at OPLA Headquarters and in 25 OPLA Field Locations.

Falcone was previously the Chief Counsel for OPLA Washington, D.C. where he led his field location in representing DHS before the Executive Office for Immigration Review, managed legal advice and counsel for Enforcement and Removal Operations and Homeland Security Investigations, and directed litigation support to five U.S. Attorney’s offices. He served as the Chief of OPLA’s Homeland Security Investigations Law Division where he was responsible for advancing ICE’s efforts to investigate and prosecute national security threats and violators of customs and immigration laws, as well as deny safe haven to human rights violators.

Falcone previously served as Deputy Chief Counsel for OPLA Washington, D.C. and served as Assistant Chief Counsel and Senior Attorney for OPLA New York, NY. He began his legal career with the former Immigration and Naturalization Service as an Assistant District Counsel in New York City. He graduated with honors from Widener University School of Law.
